These Terms of Service ("Terms") govern your access to and use of the Techctrl website and services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Services
Techctrl provides smart home design, installation, automation, and monitoring services. Our offerings include:
- Smart home consultation, design, and installation packages
- Monthly monitoring subscription plans (Basic, Pro, Elite)
- Ongoing support and system maintenance
Service details, pricing, and scope are as described on our website and in any written proposal we provide. We reserve the right to modify services with reasonable notice.
2. Consultation Requests
Submitting a consultation request through our website does not constitute a binding contract. It is an expression of interest. A binding agreement arises only upon your acceptance of a written proposal and receipt of deposit or payment from Techctrl. We reserve the right to decline any consultation request.
3. Monitoring Subscriptions
Billing: Monitoring plans are billed monthly via Stripe. Your subscription renews automatically each month until canceled.
Cancellation: You may cancel at any time from your Stripe billing portal. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for mid-cycle cancellations.
Payment failures: If a payment fails, we will notify you by email. Access to monitoring services may be suspended until payment is resolved.
Plan changes: Upgrades take effect immediately and are prorated. Downgrades take effect at the next billing cycle.
Requirement: Monitoring services are designed for Techctrl-installed systems. We may evaluate compatibility with third-party systems at our discretion.
4. Installation Services
Scope of work: Installation services are defined in a written proposal accepted by both parties. Any changes to scope must be agreed in writing.
Access: You agree to provide our technicians with safe, reasonable access to your property during scheduled installation windows.
Your responsibilities: You are responsible for ensuring your home's electrical and network infrastructure meets the requirements disclosed in your proposal. Techctrl is not liable for delays or additional costs arising from undisclosed infrastructure deficiencies.
Workmanship warranty: We warrant our workmanship for the period specified in your tier (1 year for Essential Smart, 2 years for Smart Productivity, lifetime for White Glove). This covers labor defects only, not third-party device failures or user damage.
5. Payments and Refunds
All payments are processed securely through Stripe. We do not store your payment card details. By providing payment information, you authorize us to charge the applicable fees.
Installation deposits: Deposits are non-refundable once design work has commenced unless we cancel the project.
Subscription refunds: Monthly monitoring fees are non-refundable. If you experience a service issue, contact us and we will work to resolve it.
6. Acceptable Use
When using our website and services, you agree not to:
- Submit false or misleading information in any form or consultation request
- Attempt to circumvent rate limiting, security measures, or access controls
- Use our website to transmit malware, spam, or harmful content
- Reverse engineer, scrape, or systematically extract data from our website
- Impersonate Techctrl or our representatives in any communication
7. Intellectual Property
All content on the Techctrl website — including text, graphics, logos, design system, and code — is the property of Techctrl and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
8. Limitation of Liability
To the maximum extent permitted by law, Techctrl shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim shall not exceed the total amount paid by you to Techctrl in the 12 months preceding the claim.
Techctrl is not responsible for third-party device failures, manufacturer defects, internet service outages, or events beyond our reasonable control.
9. Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Fulton County, Georgia, and you consent to personal jurisdiction in those courts.
10. Changes to Terms
We may update these Terms at any time. We will post the updated Terms with a revised "Last updated" date. Continued use of our services after changes constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify active subscribers by email.
